Proposition 65

The State of California’s Proposition 65, the Safe Drinking Water and Toxic Enforcement Act, became law in November 1986. Effective August 30, 2018, Proposition 65 will have updated labeling requirements for businesses to notify consumers with “clear and reasonable” warnings of potentially hazardous chemicals present in products. Warning labels are required on all products that contain chemicals found on the state’s list of over 850 compounds and must specify that the product contains chemicals “known to the State of California to cause cancer and birth defects or other reproductive harm.”

Dr. Ashley Wellness has reviewed the complete product line for compliance with the Proposition 65 directive. Dr. Ashley Wellness products are subject to the Proposition 65 regulation labeling requirements and bear the following warning label:

What is this warning?

These warnings are provided pursuant to a California labeling law called Proposition 65 (or Prop 65 for short), which is meant to notify individuals in California of potential exposures to Prop 65-listed chemicals.

While selling products that contain any of the listed chemicals is not prohibited, any company that does business in California is required to notify consumers if any of their products contain a chemical that is listed on the Prop 65 list.

For that reason, where appropriate, we label items sold to customers and retailers in the State of California with Prop 65 warnings to ensure compliance. What types of chemicals and products are on the Prop 65 list?

There are over 900 chemicals on the Prop 65 list, which is updated at least once every year. Any chemicals that are regarded as reproductive toxicants or carcinogens are included on this list, even though some of these chemicals are often found in nature and are not intentionally added to products.

How does Prop 65 compare to federal limits and the FDA?

Prop 65 warnings are required at levels that are more rigid than federal regulations. For example, lead.

  • The FDA maximum daily intake for lead is 12.5 micrograms.
  • The Prop 65 maximum daily intake for lead is 0.5 micrograms.
